Why You Should Report A Pothole
1. Without a Report, the County Is Usually Immune
On Long Island, Nassau and Suffolk Counties cannot be held legally responsible for pothole damage or injuries unless they had prior written notice of the exact defect.If it wasn’t formally reported, the county will almost always get the case dismissed.
2. Once Damage Happens, the Clock Is Brutally Short
If a pothole causes damage or injury on Long Island:
90 days to file a Notice of Claim
1 year + 90 days to file suit
If the pothole was never reported before the incident, those deadlines don’t matter — the claim is dead on arrival.
